80-Year-Old Man Killed in Head-On Crash in Marlborough, NH

Sandy Olds

Marlborough, NH (October 14, 2026) – An 80-year-old driver from Jaffrey died on Wednesday, October 14, after a head-on collision on Route 12 in Marlborough.

According to initial reports, he was driving a Nissan Rogue. A 23-year-old from Manchester was driving the other vehicle. That person was injured, though the injuries are not considered life-threatening.

Route 12 was closed near Webb Depot Road to let emergency workers manage the scene.

Marlborough Police continue to investigate the wreck.

Our condolences go out to the victim’s loved ones, and we wish the injured driver a strong recovery.

Who Can Be Responsible After a Head-On Accident in Marlborough, NH?

Responsibility in a head-on usually falls on the driver whose vehicle crossed into oncoming lanes, but New Hampshire law looks first at the evidence to determine fault. This is because fault can come from a medical emergency, a vehicle defect, a road hazard, or another driver’s actions.

New Hampshire follows a modified comparative fault rule. This rule allows a person to recover only if their own share of fault is not greater than the other party’s, and any award is reduced by that share.

This fault rule is what makes evidence so important. Evidence can show facts such as each driver’s speed, lane position, and attention.

However, much of that evidence can disappear quickly. Many modern vehicles store speed, braking, and steering data in an event data recorder, and that information can be overwritten or lost once a vehicle is repaired or sold for salvage.

When an accident turns fatal, New Hampshire allows families to file a wrongful death claim that is generally brought by the executor or administrator of the estate. The filing deadline to bring this claim is commonly three years, though exceptions can apply.

A wrongful death attorney can help a family work out who should act for the estate, identify every party that may share fault, and explain what damages may be available.

If you have questions about how fault is determined after a head-on collision in New Hampshire, our team at Stephen Law can help you sort through the evidence. We can explain how these rules may come into play in your specific situation.
