Evidence Families Should Preserve After a Fatal Crash in Windham, NH
Evidence can disappear faster than you may expect after a death on a Windham road. Vehicles may be repaired, released to an insurer, or sold for salvage, and surveillance or dash camera footage tends to be overwritten within days.
The most useful items usually fall into a few groups. Vehicle data comes first, since many modern vehicles store speed, braking, and seatbelt information in an event data recorder, and getting that data may require the owner’s consent or a legal order.
Photos, video, witness accounts, the written police report, cellphone records, and medical records can each help show what happened and what the loss means for a family.
These records matter most in a wrongful death claim, where both fault and damages have to be shown. In New Hampshire, these types of claims are brought by the administrator of the deceased person’s estate.
The deadline to file this claim is three years, though the exact timing can depend on the facts of each case. Although three years can appear to be a lot of time, evidence needs to be preserved early on.
To make sure it is done, a wrongful death attorney can send preservation letters, arrange vehicle and data inspections, and gather records before they are lost or altered.
