What Is the Statute of Limitations for a Wrongful Death Claim in Meredith, NH?
New Hampshire generally allows three years to file a wrongful death lawsuit arising from a fatal motor vehicle accident. Under New Hampshire Revised Statutes Annotated § 556:11, the deadline generally runs from the date of death. Missing this filing deadline can prevent eligible parties from pursuing compensation through the courts, subject to limited legal exceptions.
Under RSA 556:11, wrongful death actions are subject to the three-year limitation established through RSA 508:4. The New Hampshire Supreme Court confirmed this interpretation in Cheever v. Southern New Hampshire Regional Medical Center and later clarified in Anderson v. Estate of Wood that the three-year period begins on the date of death. gc.nh.gov+2
Fatal commercial truck accidents can leave surviving family members facing funeral expenses, lost financial support, and other financial hardships. Families may also need time to address estate matters while considering whether to pursue a wrongful death claim. Keeping records of financial losses and relevant documentation may help with the legal process.
A wrongful death attorney can review the circumstances surrounding a fatal truck collision, identify potentially responsible parties, and explain which filing deadlines apply. Claims involving trucking companies or commercial vehicle operators may require additional investigation. Certain circumstances can also affect how a filing deadline applies, making an early legal review helpful.
